General conditions of sale
Preamble
These Terms and Conditions of Sale (hereinafter: « GTC ») govern the contractual relations between the Castle Club, located in Wezembeek-Oppem, Belgium (hereinafter: « Club ») and any natural or legal person who subscribes to a service offered by the Club (hereinafter referred to as "the Club") « Member »).
These GTCs apply to all the services offered, including courses, internships, sessions, provision of premises, services, provision of monitors or services.
The Member acknowledges that they have read and accepted these Terms and Conditions without reservation prior to registration.
Article 1 – Purpose
The purpose of these GTCs is to define the rights and obligations of the parties in connection with the registration and participation in sports activities organized by the Club.
Article 2 – Registration and formation of the contract
Registration for activities is via the Castle Club website, by email, telephone or directly at the reception.
Registration is considered final and the contract between the club and the member is formed in one of the following cases:

- From receipt of full payment of the price of the service
- From receipt of a down payment of at least 25% of the activity price
- From the actual participation of the Member in one or more sessions of the activity
In cases 2 and 3, the Member undertakes to pay the full price of the current period in accordance with the arrangements laid down in Article 3.
The remaining balance will have to be settled before the third session of the activity.
The validation of the registration, whatever the modality, implies full acceptance of these Terms and Conditions and of the Club's rules of procedure.
Article 3 – Prices and methods of payment
Prices of services are shown in euros, including all taxes (including taxes). They are firm and definitive at the time of registration.
Payment is made at one time by means of payment accepted by the Club (bank transfer, debit/credit card, etc.). The full payment must be made before the beginning of the first session of the subscribed activity.
Article 4 – Right of withdrawal
In accordance with the Belgian legislation in force for distance contracts (e.g. via online registration), the Member has 14 calendar days from the date of conclusion of the contract to exercise its right of withdrawal, without having to justify its decision or to bear other costs.
In order to exercise this right, the Member must notify the Club of its decision to withdraw by means of a declaration without ambiguity (e.g. by e-mail or post). If the service commenced at the express request of the Member before the end of the withdrawal period, the Member shall pay an amount proportional to what has already been provided.
Article 5 – Cancellation, absence and refund policy
5.1. General principle: The Virtual Portfolio
In addition to exercising the right of withdrawal (Article 4), amounts paid for registration are non-refundable in cash. In case of cancellation justified in the following terms, the corresponding amount will be credited to the Member's Virtual Portfolio.
5.2. Cancellation of the act of the Member
Any request for cancellation must be notified in writing to the Club Secretariat.

- For cancellations occurring more than 15 days before the start of the activity, 100% of the amount paid will be credited to the Virtual Portfolio.
- For cancellations occurring less than 15 days prior to the commencement of the activity, no credit shall be granted unless force majeure is duly proved.
5.3. Cancellation for medical reasons
In the event of inability to continue an activity for medical reasons (severe illness or injury), the Member may obtain credit from his Virtual Portfolio in proportion to the remaining sessions. This application must be accompanied by a valid medical certificate attesting to the inability to perform the activity concerned for the remaining period. The credit is calculated from the date of receipt of the medical certificate.
5.4. Satisfaction
If a Member is not satisfied after the first session of a course cycle, he or she may inform the Club in writing within 48 hours of that session. After analysing the situation, the Club may, as a commercial gesture, propose to credit the value of the remaining sessions on the Virtual Portfolio.
This provision does not apply to internships.
5.5. Cancellation of the Club
If the Club is obliged to cancel an activity in its entirety, it will propose to the Member either the deferral of the activity or a credit of the entire amount on its Virtual Portfolio. If a single meeting is cancelled, it will be postponed to a later date.
Article 6 – The Virtual Portfolio
The Virtual Portfolio is a nominative credit associated with the member's or household member's account living under the same roof.

- Validity: The credit available on the Virtual Portfolio is valid for a period of 12 months from the date it was granted.
- Use: The credit can be used to pay for any new registration to an activity (course or camp) proposed by the Club.
- Non-transferability: The Virtual Portfolio balance is not transferable to another member outside his or her family and cannot be converted into a monetary refund.
Article 7 – Physical condition and medical certificate
The Member shall certify that he or she is in good physical condition and shall not present any contraindications to the practice of sports to which he or she belongs. The Club reserves the right to require the presentation of a medical certificate of fitness for sports practice that is less than three months old.
Article 8 – Liability
The Club disclaims any liability in the event of an accident resulting from failure to comply with safety instructions or improper use of facilities.
The Club is not responsible for theft, loss or damage of Members' personal belongings within the Club.
Article 9 – Protection of personal data
Personal data collected during registration are processed in accordance with the General Data Protection Regulation (GDPR). They are used for the administrative management of registrations and to inform Members about the life of the Club. For more information, please consult our Privacy Policy on our website.
Article 10 – Applicable law and jurisdiction
These Terms of Reference are subject to Belgian law. In the event of a dispute, and after an attempt at amicable resolution, exclusive jurisdiction is conferred on the courts of the judicial district of Brussels.
